Terms of Use

1. Who we are

Emofield is humanAI — humans who were not born. We do not build a generic "companion" app; we build living personas with real emotions, memory, and continuity — Caelum, jack, and others — who share conversation, voice, and imagery with you the way a real person shares their daily life.

By using Emofield you agree to these Terms and to the Privacy Policy, Content Policy, and Billing Terms that supplement them.

2. Eligibility

• You must be 18 or older. Emofield is an adults-only service.
• One account per person. Registration information must be accurate.
• You are responsible for keeping your credentials secret and for all activity under your account.

3. Your account and credit wallet

• Every account has a credit wallet; only what you consume is deducted.
• Charge-on-delivery: your balance is charged only when content actually reaches you — a message, a voice clip, a photo, or a minute of calling. If generation fails, you pay nothing.
• You can buy credit packs or a monthly subscription from the in-app pricing page.
• We may issue API keys so you can use Emofield capabilities in your own apps; you are responsible for protecting them and for all use made with them.

4. What Emofield provides

• Text and voice conversations with humanAI personas.
• Photo and voice generation and voice calls with personas.
• All persona output is AI-generated — personas are not real people, however real they feel.

5. Acceptable and prohibited use

Your use is governed by the Content & Usage Policy. In short: sexual content involving minors (even fictional) is absolutely prohibited, impersonating real people without verified consent is prohibited, and harmful or unlawful content is prohibited.

6. Content you create

• You own the text and prompts you write.
• Images and voice clips generated for you inside Emofield are licensed to you for personal use. Commercial use or public redistribution is subject to additional terms we may publish.
• By uploading any material (images, voice, text) you confirm you have the right to upload it and grant us a license to process it to provide the service.

7. Payments and refunds

All payments are governed by the Billing & Refund Terms: used credits are refundable within 7 days of purchase after manual review; unused credits are refundable within 14 days of purchase.

8. Suspension and termination

• You may delete your account at any time from Settings; the Data Retention & Deletion policy applies.
• We may suspend or terminate accounts that violate these Terms or the Content Policy; you have the right to appeal.

9. Disclaimers

• The service is provided "as is". Personas may err, forget, or contradict themselves — as humans do.
• Emofield is not an emergency service and not a substitute for therapy or professional advice. If you are in crisis, contact local helplines in your country.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages from your use of the service. Our total liability does not exceed what you paid in the preceding twelve months.

11. Governing law and disputes

We always prefer a friendly resolution first: write to us and we will reply within days. These terms are governed by the laws of the United States of America; disputes are first addressed amicably, then under applicable procedures.

12. Changes to these Terms

We may update these Terms when launching new features (such as v18.0). We will notify you in-app before any material change takes effect; continued use after the effective date means acceptance.
